DISTANCE SALES AGREEMENT

1. Parties

This Distance Sales Agreement (the "Agreement") is entered into electronically between the SELLER, whose information is provided below, and the BUYER/CONSUMER, who purchases product(s) via the www.masaliko.com website.

BUYER / CONSUMER

Name, surname, delivery address, billing address, phone, and email information are provided by the BUYER during the order.

2. Subject of the Agreement

The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale and delivery of product(s) ordered electronically by the BUYER through Masaliko's www.masaliko.com website.

This Agreement has been prepared within the framework of the relevant legislation, particularly Law No. 6502 on Consumer Protection and the Distance Sales Contracts Regulation.

3. Product and Order Information

For the product(s) subject to the order;

• Type and model,

• Quantity,

• Basic features,

• Sales price,

• Discount information,

• Total price including taxes,

• Shipping or other additional costs, if any,

• Payment method,

• Delivery information

are displayed to the BUYER on the website and in the order summary at the time of order creation.

The BUYER accepts that they have viewed the basic features of the product and the total payment amount before confirming the order.

4. Payment

The BUYER can pay the order amount using one of the payment methods offered through www.masaliko.com.

For payments made by credit or debit card, the terms and conditions of the relevant bank, payment institution, or card organization may apply.

If the payment transaction is not completed or not approved by the payment institution, the order is not considered complete.

5. Shipping and Delivery

Shipping is free throughout Turkey.

Products in stock are generally prepared and delivered to the cargo company within 1-3 business days.

We have agreements with different cargo companies throughout Turkey, and orders may be sent via the most suitable cargo company according to the delivery address and operational conditions.

The product subject to the order is sent to the delivery address specified by the BUYER during the order.

Unless exceptional circumstances allow a longer period by law, the product delivery is carried out within the maximum periods stipulated in the relevant legislation.

Preparation and delivery times for personalized products or those requiring special production may vary depending on product features.

6. TRNC and International Delivery

Masaliko ships to the Turkish Republic of Northern Cyprus (TRNC), European countries, and the United States, as well as Turkey.

TRNC orders are usually delivered to the customer approximately 1 week after being handed over to the cargo company under normal conditions.

For international shipments, shipping costs, delivery times, and other shipping conditions may vary by country.

For international shipments, customs duties, import taxes, or other legal fees that may arise due to the legislation of the delivery country may be the responsibility of the BUYER unless otherwise explicitly stated.

7. Right of Withdrawal

Subject to the exceptions specified in the relevant legislation, the BUYER has the right to withdraw from the contract within 14 days from the date of product delivery, without giving any reason and without paying any penalty.

To exercise the right of withdrawal, the BUYER must notify the SELLER of their decision to withdraw in writing or via a permanent data storage medium accepted by the legislation within the legal period.

After notifying the SELLER of their decision to exercise the right of withdrawal, the BUYER must send the product to the SELLER in accordance with the period and conditions stipulated in the applicable legislation.

8. Return Conditions

The returned product must be sent to the SELLER in a manner appropriate to the nature of the right of withdrawal and to the extent permitted by law.

If accessories, boxes, or other complementary elements were sent with the product, these may also be requested to be returned with the product.

The consumer's rights arising from law are reserved in case the product is defective, faulty, incomplete, or sent differently from what was ordered.

The BUYER contacting Masaliko before initiating the return process will help expedite the process.

9. Cases Where the Right of Withdrawal Cannot Be Exercised

The right of withdrawal may not be exercised in cases specified in the Distance Sales Contracts Regulation and relevant legislation.

Especially;

• For products specially prepared in line with the BUYER's requests or personal needs,

• For products containing names, dates, custom measurements, or customer-specific designs,

• For products whose packaging, seal, or similar protective elements have been opened after delivery and are not suitable for return for health or hygiene reasons,

• For other goods and services determined as exceptions to the right of withdrawal in the relevant legislation

the right of withdrawal may not apply.

For products such as earrings and piercings that come into direct contact with the body for hygiene reasons, whether the exception to the right of withdrawal applies will be evaluated in accordance with the nature of the product, whether its protective packaging has been opened, and the provisions of the relevant legislation.

The consumer's legal rights regarding faulty or defective products are reserved.

10. Refund

Refunds to be made in case the right of withdrawal is exercised in accordance with the legislation will be processed within the period specified in the relevant legislation.

Unless otherwise stipulated in the legislation, the refund will be made in accordance with the payment method used by the BUYER during the purchase.

Due to the processing times of banks and payment institutions, it may take additional time for the refunded amount to be reflected in the BUYER's account or card.

11. Return Shipping Process

The shipping process and costs for returns made within the scope of the right of withdrawal are determined according to the Distance Sales Contracts Regulation and the provisions of the applicable legislation.

It is recommended to contact Masaliko via info@masaliko.com before initiating a return shipment.

The consumer's legal rights are reserved in case the product is sent faulty, defective, or different from what was ordered.

12. Warranty and After-Sales Services

Our 925 sterling silver products at Masaliko are covered by a 2-year Masaliko warranty from the date of purchase.

Products in our imported collection are offered with a 5-year color warranty.

Warranty coverage is evaluated according to the nature of the product and the cause of the problem. Situations such as impact, crushing, breakage, misuse, or intense exposure to chemicals caused by the user are evaluated separately.

Masaliko may also offer maintenance, refurbishment, and color change services for suitable products.

13. Force Majeure

Delays in fulfilling obligations may occur due to natural disasters, war, terrorism, epidemics, strikes, transportation disruptions, communication and infrastructure problems, decisions of public authorities, and similar situations beyond the reasonable control of the parties.

In such cases, the rights of the parties arising from the applicable legislation are reserved.

14. Dispute Resolution

In disputes arising from this Agreement, the consumer may apply to Consumer Arbitration Committees within the monetary limits specified in the applicable legislation or to Consumer Courts if the relevant conditions are met.

The consumer's other rights to appeal and litigate by law are reserved.

15. Effectiveness

The BUYER acknowledges that they have been pre-informed about the basic features of the product, sales price, payment and delivery conditions, and the right of withdrawal before completing their order via www.masaliko.com; and that they will incur a payment obligation upon confirming their order.

This Distance Sales Agreement becomes effective upon the BUYER's electronic confirmation of the order.
